Who Qualifies for the EB-1C Visa?

Be Employed by a Qualifying Company Abroad — You must have been employed outside the U.S. by a qualifying organization for at least one continuous year within the three years immediately preceding your transfer to the United States (or, if already in the U.S., within the three years preceding your most recent lawful nonimmigrant entry).

Have a Managerial or Executive Role — Your position abroad must have been primarily managerial or executive in nature, and the U.S. role must also be in a managerial or executive capacity.

Transfer to a Qualifying U.S. Entity — The U.S. company must have a qualifying relationship with the foreign entity (parent, branch, subsidiary, or affiliate) and must intend to employ you in a managerial or executive position.

U.S. Employer Requirements — The U.S. employer must have been doing business for at least one year and must have a qualifying relationship with the company abroad.

Key Definitions

Managerial Capacity: You primarily supervise and control the work of other professional employees, manage an essential function or department, have authority to hire and fire, and exercise discretion over day-to-day operations.

Executive Capacity: You primarily direct the management of the organization or a major component, establish goals and policies, and receive only general supervision from higher executives or the board of directors

Filing Process

Form I-140 Petition: The U.S. employer must file Form I-140, Immigrant Petition for Alien Worker, on behalf of the manager or executive.

Adjustment of Status or Consular Processing:

  • If the beneficiary is in the U.S., they may file Form I-485 to adjust status when a visa number is available.

  • If outside the U.S., they will complete consular processing through a U.S. embassy or consulate.

No PERM Required: Unlike other employment-based categories, the EB-1C does not require a labor market test or PERM labor certification.
